LSNV’s consumer practice focuses on protecting our clients from descending into poverty. We combat the threat of poverty by ensuring all legal steps have been taken by creditors and debt collectors, and by investigating unfair, fraudulent, or predatory consumer practices.
To accomplish this, we utilize a variety of federal, state, and common laws, such as the
- Virginia Consumer Protection Act (VCPA),
- Virginia Uniform Commercial Code, and
- Federal Consumer Credit Protection Act (FDCPA).
Many of these cases involve court actions in the General District and Circuit Courts across Northern Virginia.
Unfortunately, we cannot represent every client, so we prioritize cases where the client is facing the loss of a critical economic resource, such as income through a wage or bank account garnishment, or other collection activity. In the cases where a client is facing the loss of a critical economic resource, we may include a more detailed financial screening to determine if the individual is a candidate for Chapter 7 bankruptcy protection.
When a client is not facing the loss of a critical economic resource, the services we can provide to protect our clients include counsel and advice, drafting documents, negotiating settlements, or court representation.
We also conduct outreach services at various jurisdictions across Northern Virginia that consist of providing legal resources and information regarding the litigation process. The resources and information we provide educates the public on the litigation process for collection actions, debtor rights and protections, and how to bring a VCPA and FDCPA claims. Also, we generate and share digital and paper materials to further our objective of the educating the public of their legal rights.
